Bankruptcy Appeals

The bankruptcy appeals’ process can be challenging even for experienced bankruptcy counsel.  The time frames are short, and procedure varies across federal circuits.

A Varied Procedure Requires Experienced Counsel

Some circuits, including the United States Court of Appeals for the Ninth Circuit, have set up Bankruptcy Appellate Panels to hear bankruptcy appeals.  These panels consist of three bankruptcy court judges.  However, bankruptcy appeals may also be heard in the relevant federal district court.

The deadline to file a bankruptcy appeal is short, so contact us before the Bankruptcy Judge enters a judgment if at all possible.  If the deadline is missed, the court cannot hear the appeal.
